Government to issue new directive prioritising community safety when considering visa cancellations

In Australia, new ministerial directive will be issued to prioritise community safety when reviewing cases of visa cancellations, Prime Minister Anthony Albanese confirmed.

Last year in January, the migration minister issued revelations on a direction had resulted in convicted criminals being allowed to stay in Australia.

The federal government has suffered criticism over the last two weeks as the direction had insisted immigration officials and tribunals take into account an individual’s ties to the community and their time spent living in Australia to revoke or reinstate their visa.

There is an individual that reinstated visa and is now accused of murder in Brisbane.

The case forced Immigration Minister Andrew Giles to cancel the visa and ordered an urgent review of dozens of others.

There are other consequences showed by the Administrative Affairs Tribunal (AAT) on the direction where the tribunal having reinstated the visas of convicted rapists, armed robbers, drug smugglers and people involved in kidnapping.

To avoid the same mistake, it’s better to issue a new revised direction which ensure that the protection of the community outweighs any other consideration, Mr Albanese told Question Time.

The new ministerial directive will be known as Ministerial Direction 99 was signed in early 2023.

“The revised direction will also strengthen the principles of community safety in the making of decisions, including the impact of the decisions on the victims of crime and their family members, and also strengthen the family violence provisions to reflect the government’s and Australians more broadly commitment to end violence against women and children,” Mr Giles told Question Time.
